American Airlines "BlackAtlas" Posting Terms and Condition ("Terms")
By submitting a post for the BlackAtlas website at www.blackatlas.com, you agree to the following terms and conditions:
1. Application of Terms
"Content" includes any ongoing electronic chronicle of information to be posted on the BlackAtlas website, including, but not limited to, any text, video or photo content.
2. Submission Guidelines
- Each article posted on BlackAtlas should be no longer than 400 words. Articles should be written in first person, in a formal tone, and should include minimal slang. Please make sure to spell check and review your submission for any grammatical or punctuation errors. Articles should focus on why the location or business is of interest to African American travelers.
- Photos must be in one of the following file formats: JPG, GIF or PNG and must be smaller than 5 MB in size. Remember to include a caption with each photo so that readers know what the photo is depicting, captions should not exceed 100 words per photo.
- Videos must be in one of the following file formats: AVI, MPEG, QuickTime, Real, or Windows Media and must be no more tan 100 MB in size and 3 minutes in length. If the video is hosted on a YouTube channel, please provided BlackAtlas with the link. Videos should depict your surroundings, please do not submit "diary" or "stand up" videos in which you stand in front of the camera and narrate. Use a microphone for interviews, when possible.
- Ensure that all photos and videos are in focus, and that you have obtained the permission to post the photo or video from every identifiable individual that is depicted, or have edited the photo or video so that other individuals are not identifiable. If you have included photos or videos of a business, please be sure to inform the business' of the purpose of your photo or video prior to submitting the photo or video to BlackAtlas.
3. What Businesses May Be Reviewed for BlackAtlas
You may not submit a review for particular business for BlackAtlas if:
- You have received any incentive to encourage you to submit a review, including discounts, free products or free services;
- You have a direct financial interest in the business which you are reviewing (e.g., you owns stock in the business); or
- You have an immediate family member (defined as spouse, parent, child, sibling and their respective spouses) or a household member who has a direct financial interest in the business which you are reviewing;
- You have a personal relationship with an individual, other than an immediate family member, who has a direct financial interest in the business, unless you have obtained permission from the individual and you inform the Content Director of the relationship and, if requested by BlackAtlas, disclose the relationship in the review.
4. Give Your Honest and Truthful Opinions
Your statements should reflect your honest and truthful opinions and actual experiences and clearly state that the views expressed are yours alone and (to the extent applicable). That being said, be aware that stating even your honest views about a business, its competitors or its respective industries may have repercussions to you. You assume all risks associated with your Content, including anyone's reliance on its accuracy, completeness or usefulness, or any disclosure by you of information in your Content that makes you personally identifiable.
5. Only Make Factual Statements That Are Truthful and Can Be Verified
Only make a factual statement about a business or a product/service's characteristic or quality which you know for certain is true and can be verified. Remember that even if you don't expressly state a fact, it may be implied, and these Terms apply to both express and implied messages. Be especially careful about making any false statements about a business, its competitors, or either's products/services, as BlackAtlas does not support any false or misleading statement or comparison. All posts submitted to BlackAtlas will be monitored/screened, however, posts will not be edited and do not reflect the views of BlackAtlas. You acknowledge that BlackAtlas has no obligation to use or post any review you submit.
6. Do Not Disclose Any Confidential Information
If you are in a position whereby you have received information about a business, or its products or services, or internal business operations (including financial matters), that is not known by the general public or is subject to a Non-Disclosure Agreement, do not include such information in any Content. To the extent you have any question whether information is confidential in nature err on the side of caution and do not disclose it.
7. Intellectual Property Rights
- You should know that you are personally liable under federal and state law for your actions with respect to your BlackAtlas posts, which makes following these Terms, as well as all other applicable laws, regulations and other legal authority, particularly important. Furthermore, you should know that BlackAtlas will hold you directly responsible for any claims which arise from your violation of the law, or BlackAtlas' rights or the rights of any third party.
- By submitting a Entry you warrant and represent that it is your original work, does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity and that use of your submitted Content via various media including Web posting, will not infringe on the rights of any third party rights. You further agree to indemnify and hold harmless, BlackAtlas, its owners, agencies their respective parents, subsidiaries, and affiliates and each of their employees, officers, and directors from any claims to the contrary or any claims arising out of your breach of these Terms.
8. You Are Personally Responsible For Your Actions
- You should know that you are personally liable under federal and state law for your actions with respect to your BlackAtlas posts, which makes following these Terms, as well as all other applicable laws, regulations and other legal authority, particularly important. Furthermore, you should know that BlackAtlas will hold you directly responsible for any claims which arise from your violation of the law, or BlackAtlas' rights or the rights of any third party.

9. We Reserve The Right To Remove Content
By submitting Content, you agree that BlackAtlas may remove any Content submitted by you in connection with BlackAtlas upon the determination that the content of the post is objectionable or not otherwise in compliance with these Terms.
10. Governing Law
By submitting a review, you agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of BlackAtlas in connection with this website, shall be governed by, and construed in accordance with, the laws of State of Illinois without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Cook County, Illinois.
11. Questions and Notices
- Any waiver of any obligation hereunder by BlackAtlas does not constitute a general waiver of any obligation to you.
- These Terms may be modified or updated from time to time and is effective as of October 14, 2009.
- If you think that any Content on the BlackAtlas website infringes your intellectual property rights, report it to our DMCA agent.
